Hi Readers,
My fiance has a (U.S) MS degree in Chemistry but has been working on H1b as a computer programmer for the last 2 years ? All her undergraduate work has also been in the Sciences. Her GC sponsor is a software company and she will be applying as a computer programmer. Does anyone have experience with this kind of Labor Certification situation ? Thank you for any help.

A new study by the Transactional Records Access Center (TRAC) finds that the nation's Immigration Courts are becoming increasingly backlogged. Our country's 234 immigration judges received over 350,000 new cases last year, almost 1,500 cases per judge. Coupled with the government's onerous "case complete goals", this brings incredible pressure on overworked immigration judges to issue decisions. Reform Immigration For America reports that 500,000 people participated in May Day protests at 80 events around the country. I was attending my 20th law school reunion this weekend in Chicago so took the opportunity to attend the event in the Windy City. The crowd was enthusiastic with lots of signs criticizing SB1070 and calling for immigration reform. And lots of US flags .

Please explain how you have worked in Illinios for XYZ company( my GC sponsoring Company) living in MN,WA and TX.
The above description is the one line RFE that I got. I don't have more details to give. I guess am like any other consultant who works in different states( Most of them).
My 140 is approved in Dec 2007. I had 1st RFE on I-485 and submitted the same in Dec 2009. for pay stubs and other things. This is the second RFE. I will consult good attorney. Any advise is helpful.
Also I entered US on AP and I started my own company few months back. I am still working for GC sponsoring company. If by my bad luck my 485 gets denied..what are my options? Also I have my H1 petition valid till May 2012 but I don't have it stamped. Do I need to leave the country and get it stamped?

I got H1 this year. I was applied my ssn on oct 9 th. still i didn't get my ssn number. two days back ssn people called and told that "in online it is showing your EAd card. so we can give u ssn if you bring the EAD card". My question is if i give my EAD, will the h1 get cancelled. please suggest me.
Dont worry, showing EAD to SSA office will not cancel or invalid your H1B. Goto SSA office and tell them you have both H1B as well as EAD.

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.

No. You can't port PD from spouse.
You can port your own PD, if you have another EB3 approved.
You can port the country of chargeability, if she was born in another (ROW) country.
My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

depends on state law, WA state does not consider H4 as a resident, just found out a month ago, when my wife finished all the tests and everything else and found she had to pay non resident tuition. So she decided not to go to school. CA considers H4 as a resident provided all other criteria are met.
