Are you allowed to work on H1b for your primary employer and EAD for your own LLC. My wife applied for 485 as a derivative applicant. She has her H1b valid until next year. When she resumed work last year after her pregnancy she submitted her EAD card to the employer's attorney. So far she was under the impression she is now working on EAD. Suddenly the attorney calls her and tells her that they are recommending and H1 extension.
Which is fine if it is possible but in the meantime she has started her own LLC which is likely to generate revenue soon. Is it valid for her to do so while resuming H1b status? Will it be construed that she is working for her own LLC using her EAD.

05/30/2008: Corrected TSC I-140 Processing Times - Not 08/26/2007 But 07/16/2007
* AILA has reported that the TSC corrected the error in its 05/15/2008 processing time report for the I-140 processing times. The date of 08/26/2007 was an error and the correct date should have been 07/16/2007. The official report will be corrected soon :(

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

Do note that AILF does cover people who were eligible to file in July but did not file due to USCIS/DOS revised bulletin.....However, it is unknown at this time what the outcome of the lawsuit would be for July applicants vs eligible but non-applicants as the decision is at the discretion of the Judge.....

I am planning to apply for my EAD/AP renewal. This would be my 4th EAD/AP application, but this is the first time I am planning to e-file.
My I-485 was filed with VSC but later got transfered to TSC. While my wife's I-485 is transfered to Newark, NJ USCIS local office. Given this situation where should be the supporting documents be sent ?
1) VSC: since all my previous EAD/AP were applied there
2) TSC: since my case is currently pending here.
3) what @ my wife's EAD/AP renewal? here case is pending at local USCIS office.

Doesn't matter if you only live in AZ or not! If you live in the Border Areas (North and South), or are traveling in those areas, it is better you carry it.
I never carry mine and do not intend to unless fit I the above case. I have memorized my A# and that of my spouse and am willing to go thro' to whatever rare hassle that I may face than losing my wallet and having to replace my GC for $370! Futher I do not want identity thieves getting another piece of info about me.

PERM approved last April
The lawyer is planning to file this week for i131-i765-i485 (target is wednesday)
Would it be ok for me to travel abroad next week, or are there some travel restrictions after we file the forms?
Do we need an official receipt from USCIS before I can leave the US, or before I came back from the US, or any other restrictions?
Would some of you know?

Our Application was also received by M.Salcedo at TSC on August 2nd. We got all our receipts on October 1st. When I checked the status online for 765, the status showed - 'Card Production Ordered'

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

If you are considering working for Sharper Impressions painting... don't. THEY WILL RIP YOU OFF. They prey on those who don't have the money or the resources to fight them. As far as i know this fee does not apply from second extension on with the same employer
