Hi,

I got an LUD on my I140 on 07/28/07. There is no message change though. This I-140 was approved way back in Aug 2006. I have filed my I-485 etc on June 1st 07, and its in process. Does anyone know what doesn this LUD mean.

It has to be receipt date FIFO, but can never say how USCIS will processes.

With my experience from Backlog Elimination Center's, USCIS works using a pure random function that gets seeded randomly from congress.

Please let me know if 140 processing times is based on receipt date or notice date?

I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

Company A filed my I-140 and it got approved, however I have not been provided with copy of the approval notice. I don't have the receipt number either. In this case, is it possible to obtain the copy of I-140 thru FOIA (Freedom of Information Act)?

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. The questions is, if i have an approved I-140 from Company A and I switch over to Company B, then would i be able to file my 485 based on 140 related to Company A when my PD for Labor (company A) becomes current.

Hi,
I have applied for COS from L1-B to L1-A and received an RFE which we have responded to.
The application is still pending with USCIS, while my I-94 is expiring on 07/31

What will happen if I do not receive decision before expiry of my I-94? Will I be out of status after the I-94 expiry date.
I have my I-485 pending as well (I-140 approved) and have EAD but not used.

14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)

First check if the check you or your company sent for H-1 fees got cashed , if so see behind the check ( normally banks post scanned copy of check ) the Receipt number will be written behind the check ..hope this helps

Hi,

I'll appreciate if someone can help me clarify my below questions.

my situation:

- my h1b visa was rejected in my home country in Mar'2010 and I applied for h4 and came back to US in june'2010.
- I am on h4 visa currently.
- I've a h1b petition valid till dec' 2010 (with company A)


Ques:

- If I apply for a transfer (with a new company B) of my H1b petition and also file a COS (i.e h4 to h1b) , does uscis going to give me a new I-94 or they'll approve my transfer without an i-94. I guess my question is that is it totally a USCIS discretion to give I-94 or we can do something to make sure that we get an I-94 in order to avoid travel and visa stamping.
( I've heard that they are troubling people who are filing h4 to h1 COS)

- Can I also file an extension (simultaneously with transfer and COS) of my current h1b based on my I-140 approval (I am planning to file I-140 within 15 days in premium) so that I can get 3 yrs extended on my h1b.

Can someone please tell me on how to reach the customer service personal? What are the options to press after 1-800-375-5283.

I received a Biometric Apt. through my attorney a month back and I appeared for the apt. The time was coincided with my move so it went to attorney and didnt come to my address.

Now I received another notice dated one month later than the first one. So I want to talk to them and findout if it necessary to appear again.
