What will the answer to the question Current immigration status while filing EAD electonically, i am on EAD rite now and i have never used my advance parole.* Pls help..

A friend of mine has submitted visa application fee and has made an appointment for visitor visa next week.
Can someone please tell if there is any other requirement of making a draft for some other fees during the Visa interview? (I am confused because a couple of years ago we used to submit one more bank draft during Visa interview)

Hi,
Need some help here for my friend.
He is an employee of company A and his first 3 yrs H1 is ended say Sep
25, 2009. But he was already got a new H1 approved 1 month back from
company B and that company had assured him to take him on board from
Sep 26, 2009. So he and his wife had both approved H1/H4 from Company
B. Now last minute the company B backed off from their agreement.
So he went back to his company A and asked for H1 extension on Sept
24, 2009 and for which they filed papers. But they didn't file papers
for his wife's H4. Can she be on company B's approved H4? if not how
many days she has to file for H4 linked to company A.

I applied GC for me and my spouse thro' EB3, AOS in July 2007, with Priority date 2005.
Currently I am in H1B and my spouse uses EAD to work.
2nd case:
My spouse applied the labor process and planning to apply I-140 in EB2 and choose CP process , once Labor approved.
Question:
For Spouse:
Is it possible to use EAD (1st case, as benificiary) to work and go for CP in 2nd case (Primary)?.
For me:
Can I add my name in CP (as Benificiary), with out effecting the my process AOS/H1B (1st case)

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

I'm on H1b visa in my 6th year. Perm application has been filed and I hope to get it approved soon along with approved i-140 (fingers crossed).
From what I have read on this forum so far, H1b transfer to a new job after an approved I-140 seems to be possible even after 6 years on H1. My issue is that I currently work for a university (non-quota H1) so if I get a new job most likely it will be with a for profit company which would require me to get a new H1 (and not H1 transfer).
So, the question is whether it is possible to get a new H1 after 6 years on H1?

I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly.
