Hi,
1. I am planning to work with a new employer on EAD. As i have heard in order to file AC21 the employer letter should present same job description as previous. I would like to know what are the other things we need to consider in order to be safe while filing AC21.
2. I requested my current employer to provide the copy of Labor certification that was filed for me. I received the following response from XYZ Company Inc., DOES NOT RELEASE COPIES OF THE LC, AS IT IS OUR APPLICATION WITH THE DOL FOR A POSITION NOT AN EMPLOYEE AND IT IS CONSIDERED PRIVILEGED AND CONFIDENTIAL.
How should I have to obtain the Job Code etc.,?

I have not found many sites that go beyond the basics of Swift 3D such as mine (www.kirupa.com/developer/...ndex.htm). (http://www.kirupa.com/developer/swift/index.htm).) I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:
a) Between 8/15 and 10/1, are we out of status?
b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?
c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.
Any suggestions are welcome. Thanks.

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..
Logiclife had started a thread (http://immigrationvoice.org/forum/showthread.php?t=895)that clearly explains why you should contribute.. we have about 2800 members that are yet to contribute... Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..

Hello,
Need advise since I'm planning to get my H1 B stamped... On my 2nd visit on B1 Visa (Business) in 2005 I got an offer to complete my master's degree(sponsorship). I applied for a change of status and was approved. I completed my master's degree and filed for OPT which got approved and finally H1. I'm currently working for more than a year on H1 B visa. I was planning to get stamping done at Hyderabad, India.
Is it safe enough to get the visa stamped? And, do I need to take any additional documents to ensure that the visa gets stamped.... Please advise....

I need your suggestions on my situation and below is the same.
1. Priority date (04Oct2006) is current in June bulletin
2. Applied labor & I40 with previous employer.
3. Applied I485 in July 2007 ( applied I 485 before marriage) with previous employer
4. Joined other employer on Sep 2009
5. Not applied AC21 portability to new employer.
Now my priority date is going to be current as of June 1st, so need to file I-485 for my wife. Based on my situation could you please suggest the best approach to apply dependent's I485. i.e Apply dependent I485 from previous employer or through my new employer asking for AC21 along with employment verification letter).
Appreciate your help in advance.

Hi,
I was on H1 VISA when my wife came here on H4 VISA. When I was filled her DS-157 form for H4 Stamping by mistake I put the wrong dates of employment.
Now she got her H1 Visa approved when she was here in US. She is going for H1 Visa stamping . She is filling her DS-157 again with the correct dates. Would it be a problem. Would H4 DS-157 be tied back to DS-157 for H1 while she is there for H1 Stamping.
Please any help would be appreciated.

1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.

- Client Letter, role/responsibilities, duties, technologies used, company profile etc.
This letter also clearly stated all entities involved and their relationships with each other.
- Purchase Order and Other contract related stuff (all possible). Everyone co-operated.
- Badge (main bulding, her office), timesheets
- photos (cubicle/office building,company logo etc), login screen, machine etc, client phone directory
- copies of recent pay stub and offer letter, job duties
Thanks to everyone who contribute on this forum. It helped us a lot. This is for my wife.

My current H1 is valid for 8 more months and I will have 1 more year after that to finish my initial 6 years, that gives me about 1 year 8 months before I exhaust the 6 year limit.
My question is if I change jobs and an H1 transfer is requested right now....will the transferrred H1 be valid for only 8 months ? or will I get a new I797 with 20 months validity? Help if some one knowledgeable about the issue would comment
